The good news is,\u00a0you have\u00a0robust\u00a0rights if that shiny model you\u2019ve\u00a0bought\u00a0turns\u00a0out to be\u00a0a jalopy!\u00a0Let\u2019s\u00a0lift the\u00a0bonnet\u00a0and steer you in the right direction.<\/p>\n

Short-term right to cancel<\/h2>\n

When you buy from a car\u00a0dealer, the car must be fit for normal use as intended. It\u00a0must continue\u00a0to\u00a0work\u00a0normally\u00a0for a\u00a0reasonable\u00a0time.\u00a0If the car\u00a0is\u00a0faulty<\/a>, you can cancel the contract altogether within the first 30 days\u00a0and ask for\u00a0a full refund.<\/p>\n

Other options open to you include a repair, replacement or a price reduction. The business who sold you the car is responsible for solving your issue, if you paid with cash or a loan. If the garage repairs your car, the repair should fix the problem. If it has been repaired and the problem happens again , you may refuse further repairs and look for a replacement car or a full refund.<\/p>\n

When\u00a0aren\u2019t you\u00a0covered?<\/h2>\n

If\u00a0the\u00a0fault is due\u00a0to misuse, wear and tear or accidental damage\u00a0you will not be covered by consumer rights law. Even though new and\u00a0second-hand\u00a0cars are both\u00a0protected, wear and tear in the case of older\u00a0cars is\u00a0taken into consideration.<\/p>\n

Top Tip<\/h3>\n

When you trade in your car for another one and something goes wrong, your consumer rights still apply. You must be refunded the full amount of the car you traded in, or offered a replacement car to the same value. If the dealer has not already sold your trade-in, you can get it back.<\/p>\n<\/div>\n

Resolving\u00a0your issue<\/h2>\n

Your first step should be to\u00a0contact the car dealer\u00a0and give them the opportunity to fix the problem. If you believe they have breached your rights, you can\u00a0make a\u00a0formal\u00a0complaint. If the\u00a0amount\u00a0you paid for the car is less than \u20ac2,000,\u00a0you can\u00a0use the\u00a0small claims procedure<\/a>.<\/p>\n

If you paid for your car through hire purchase or a personal contact plan (PCP) and find a fault, it\u2019s\u00a0a bit\u00a0different. Your contract is with the finance company\u00a0as they\u00a0legally own the car. They are\u00a0responsible for fixing the issue.\u00a0You\u00a0should still return to the car dealer\u00a0first\u00a0and ask them to\u00a0repair the fault.<\/p>\n
