{"id":7675,"date":"2016-02-24T11:26:48","date_gmt":"2016-02-24T11:26:48","guid":{"rendered":"https:\/\/www.ccpc.ie\/business\/?p=7675"},"modified":"2017-05-26T10:03:13","modified_gmt":"2017-05-26T09:03:13","slug":"enforcement-action-taken-creative-retail-solutions-limited","status":"publish","type":"post","link":"https:\/\/ccpc.inventise.ie\/business\/enforcement-action-taken-creative-retail-solutions-limited\/","title":{"rendered":"Enforcement action taken against Creative Retail Solutions Limited"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p>The Competition and Consumer Protection Commission (\u201cthe CCPC\u201d) has today published details of enforcement action taken against Creative Retail Solutions Limited. \u00a0The enforcement action was taken in relation to the display of a sign at the company\u2019s temporary store, \u201cGadget Box\u201d, Grafton Street, Dublin 2. The sign notified consumers that it was the shop\u2019s strict policy not to provide refunds and that Gadget Box would only exchange goods within 24 hours of purchase and with a receipt.<\/p>\n<p>The CCPC formed the view that the sign suggested to consumers that their statutory rights were restricted. Under consumer law a consumer has rights, including a right to reject the goods and obtain a full refund, if an item that they purchase is faulty. Traders cannot restrict those rights.\u00a0 Furthermore, businesses are not permitted to set a time limit on returning faulty goods. As a result the CCPC issued a <a href=\"https:\/\/ccpc.inventise.ie\/business\/wp-content\/uploads\/sites\/3\/2017\/02\/gadget-box-CN-20151222103118.pdf\">Compliance Notice<\/a> directing the company to cease displaying statements that could mislead consumers as to their rights.<\/p>\n<p>The CCPC\u2019s enforcement action in this case specifically relates to a breach of the Sale of Goods and Supply of Services Act 1980. This legislation gives consumers the right to expect that the goods they purchase are of merchantable quality, fit for the purpose they were bought for and as described. If goods fail to comply with any of the above and the consumer is not to blame \u2013 i.e. due to misuse, accidental damage, or wear and tear \u2013 consumers have a number of options to seek redress from the trader.
