{"id":49161,"date":"2025-04-10T17:18:55","date_gmt":"2025-04-10T16:18:55","guid":{"rendered":"https:\/\/ccpc.inventise.ie\/business\/?p=49161"},"modified":"2025-04-10T17:18:55","modified_gmt":"2025-04-10T16:18:55","slug":"ccpc-issues-decision-on-kwd-group-acquisition-of-bord-na-mona-recycling","status":"publish","type":"post","link":"https:\/\/ccpc.inventise.ie\/business\/ccpc-issues-decision-on-kwd-group-acquisition-of-bord-na-mona-recycling\/","title":{"rendered":"CCPC issues decision on KWD Group acquisition of Bord na M\u00f3na Recycling"},"content":{"rendered":"<p><span data-contrast=\"auto\">The Competition and Consumer Protection Commission (CCPC) has cleared, subject to a number of legally binding commitments, the proposed acquisition by KAES Recycling Holdings Ltd, part of the KWD Group, of Bord na M\u00f3na Recycling Ltd <\/span><a href=\"https:\/\/www.ccpc.ie\/business\/mergers-acquisitions\/merger-notifications\/merger-notification-m-25-010-kaes-recycling-holdings-limited-bord-na-mona-recycling-limited\/\"><span data-contrast=\"none\">(M\/25\/010).<\/span><\/a><span data-contrast=\"auto\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The proposed acquisition was notified to the CCPC on Friday 7 February 2025 following detailed pre-notification discussions between the merging parties and the CCPC\u2019s case team. The merging parties proposed remedies early in the review process.\u00a0\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The CCPC undertook a preliminary investigation which looked at how the deal would affect levels of competition between providers of waste collection services. During this investigation, the CCPC had particular concerns about how levels of competition in certain parts of Leinster and Munster would be affected by the proposed acquisition. To address the CCPC\u2019s concerns, KAES Recycling has agreed to divest a certain number of domestic and \u2018commercial &amp; industrial\u2019 customers in these areas to another waste collection provider, to be approved by the CCPC. The CCPC has approved similar remedies in previous waste mergers such as <\/span><a href=\"https:\/\/www.ccpc.ie\/business\/mergers-acquisitions\/merger-notifications\/m-22-067-thorntons-recycling-carducci-holdings-the-city-bin-co\/\"><span data-contrast=\"none\">Thorntons\/City Bin<\/span><\/a><span data-contrast=\"auto\"> and <\/span><a href=\"https:\/\/www.ccpc.ie\/business\/ccpc-requires-commitments-from-pandagreen-to-acquire-waste-company-exomex\/\"><span data-contrast=\"none\">Pandagreen\/Exomex<\/span><\/a><span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The commitments given by KAES Recycling also include obligations that will ensure that transferring customers will be supported throughout the process and that they will be fully informed of their rights and options.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The CCPC has accepted the commitments made by KAES Recycling and approved the purchase. An independent monitoring trustee will be appointed to make sure that KAES Recycling complies with these commitments.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Notwithstanding this merger decision, the CCPC continues to be of the view that the household waste collection market in Ireland is not delivering strong outcomes for consumers. It continues to be the CCPC\u2019s view that structural changes are required in this market and that an economic regulator for household waste collection should be established.
