{"id":48975,"date":"2024-11-08T12:44:41","date_gmt":"2024-11-08T12:44:41","guid":{"rendered":"https:\/\/ccpc.inventise.ie\/business\/?p=48975"},"modified":"2024-11-08T12:44:41","modified_gmt":"2024-11-08T12:44:41","slug":"ccpc-and-eu-consumer-authorities-inform-temu-that-they-are-under-scrutiny-for-potential-breaches-of-consumer-protection-law","status":"publish","type":"post","link":"https:\/\/ccpc.inventise.ie\/business\/ccpc-and-eu-consumer-authorities-inform-temu-that-they-are-under-scrutiny-for-potential-breaches-of-consumer-protection-law\/","title":{"rendered":"CCPC and EU consumer authorities inform Temu that they are under scrutiny for potential breaches of consumer protection law"},"content":{"rendered":"<p>The Competition and Consumer Protection Commission (CCPC), along with Belgian and German consumer authorities, are scrutinising Temu for potential breaches of consumer protection law.<\/p>\n<p>The ongoing investigation, which is being carried out through the European Commission\u2019s <a href=\"https:\/\/commission.europa.eu\/live-work-travel-eu\/consumer-rights-and-complaints\/enforcement-consumer-protection\/consumer-protection-cooperation-network_en#:~:text=In%20order%20to%20protect%20consumers,issues%20in%20a%20coordinated%20manner.\">Consumer Protection Cooperation (CPC) Network<\/a>, has identified practices which may mislead consumers or unduly influence their purchasing decisions.<\/p>\n<p>Known for selling heavily discounted products manufactured in China, Temu has its European base in Dublin.<\/p>\n<p>Temu now has one month to propose commitments on how they will address the identified consumer law issues.<\/p>\n<h2>Key elements of the investigation<\/h2>\n<p>The ongoing investigation is being jointly carried out by the CCPC, Belgium&#8217;s Directorate General for Economic Inspection and Germany&#8217;s Federal Environment Agency on behalf of the European Commission\u2019s Consumer Protection Co-operation (CPC) Network.<\/p>\n<p>Several problematic practices have already been identified and are considered by the CPC Network to be in potential breach of EU consumer protection laws. These include:<\/p>\n<ul>\n<li><strong>Fake discounts<\/strong>: Giving consumers the false impression that products are discounted when they are not.<\/li>\n<li><strong>Fake pressure<\/strong>: Putting consumers under pressure to complete purchases using tactics like false claims about limited supplies of products or false purchase deadlines.<\/li>\n<li><strong>Missing and misleading information<\/strong>: Displaying incomplete and incorrect information about consumers\u2019 legal rights to return goods and receive refunds. Failing to inform consumers in advance that their order needs to reach a certain minimum value before they can complete their purchase.<\/li>\n<li><strong>Fake reviews<\/strong>: Giving inadequate information about how Temu ensures that reviews published on its website are genuine. National authorities identified reviews which they suspect to be fake.<\/li>\n<li><strong>Hidden information<\/strong>: Forcing consumers to play a \u2018spin the fortune wheel\u2019 game to access the online marketplace, while hiding essential information about the conditions of use that apply to the rewards of the game.<\/li>\n<\/ul>\n<p>Information has also been requested from Temu to assess if it is following EU consumer laws on discount calculation, product ranking, review and rating authenticity, trader identification, and environmental claims.<\/p>\n<p>Kevin O\u2019Brien, Member of the Competition and Consumer Protection Commission, said:<\/p>\n<blockquote><p>\u201cThe investigation has found potentially misleading practices including fake discounts, fake countdown timers, and missing or misleading information about products, sellers and consumer rights.
