The Competition and Consumer Protection Commission (CCPC) is implementing the following permanent changes to the merger notification procedure:<\/p>\n

Notification format<\/h6>\n

From Wednesday 1 December 2021, all merger notifications (including all supporting documentation) are to be submitted in electronic format only to mergers@ccpc.ie<\/a>. Applications will no longer be accepted by fax. The Notification Form
\nmay be signed using an electronic signature.<\/p>\n

Timeframes for submission<\/h6>\n

Completed applications should be submitted to mergers@ccpc.ie<\/a> between the hours of 09.00 and 15:00, Monday to Friday (excluding public holidays).<\/p>\n

Incomplete notifications & supporting documents<\/h6>\n

For the purposes of determining the appropriate date under the Competition Act 2002 (as amended), where the notification and all<\/u> supporting documents are not fully received by 15:00, the CCPC will consider the date of receipt of the notification to be the next working day.<\/p>\n

Notification Information Requirements<\/h6>\n

Where the merger may relate to overlapping products or services, applicants are now required under sections 4.8, 4.9 and 4.10 of the Merger Notification Form to provide the names and e-mail addresses of their top twenty largest customers, suppliers and competitors.<\/p>\n

The CCPC\u2019s Merger Notification Form<\/a>\u00a0and Mergers and Acquisitions Procedures<\/a>\u00a0have been updated to reflect these changes. Queries on the changes should be sent, via email, to mergers@ccpc.ie<\/a>.<\/p>\n
